The following notice is published for Informational Purposes Only. This is not a request by the Government for submittal of proposals or quotes of any kind. The Government intends to issue, on a Sole Source basis, a Firm-Fixed Price contract to LMB North America, Inc., 990 Biscayne Blvd. Suite 701, Miami, Florida 33131-1556, in an effort to procure quantity two (2) Hyperfan 150-01 (PN: 00-85001362-001) in support of the United States Test Pilot School, Patuxent River, Maryland. This acquisition is being procured on a sole source basis under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy requirements. LMB North America, Inc. is a subsidiary of LMB SAS, the original equipment manufacturer (OEM) of Hyperfan 150-01. LMB North America, Inc. is the only commercially recognized seller of Image Systems software and hardware with no other authorized distributors or resellers within North America. Market research has revealed that no other known contractor could immediately satisfy the Government s requirement without a significant disruption of services due to the time and cost it would take to acquire technical data rights from the OEM. Based on FAR 6.302-1, LMB North America, Inc. is the only known source that has the technical data, knowledge, experience, and capability necessary to fulfill the Government s need and meet its requirements within the defined schedule. This acquisition will be manufactured in France and will include Duty-Free Entry based on DFARS 252.225-7013. Naval Air Warfare Center Aircraft Division (NAWAD) has awarded a Firm-Fixed-Price (FFP) Contract to LMB North America, Inc., Miami, Florida, for the procurement quantity two (2) Hyperfan 150-01 (PN: 00-85001362-001) in support of the United States Navy Test Pilot School, Patuxent River, Maryland. This acquisition was pursued on a sole-source basis under statutory authority of Title 10, U.S.C. Section 3204(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." The determination by the Government not to compete this effort was solely within the discretion of the Government.
