INTENT TO SOLE SOURCE The Department of Veterans Affaris Network Contracting Office (NCO) 6 in support of the Durham VA Health Care System (VAHCS) intents to enter into a sole source with Excel Imaging Solutions, 73000 Cessna DR, Greensboro, NC 27409. NAICS code 334517, Irradiation Apparatuss Manufacturing. The proposed contract action is to provide the Durham VAHCS with a full-service coverage for preventative maintenance and repairs for Samsung GM85 mobile x-ray systems. The contractor shall provide preventative maintenance services and repairs of the Samsung GM85 mobile x-rays systems for six (6) systems to include; full-service coverage to include parts, labor, annual preventative maintenance, and detector, detector configuration, wireless detector battery coverage, GM85 system battery coverage, and remote support for unlimited technical and application support, and Samsung wireless detector accidental damage coverage as outlined in the Performance of Work Statement (PWS). The Government intents to solict and negotiate with only one source under the authority of FAR 13.106-1(b), Soliciting form a Single Source. Contract will be for a base year plus four option years not to exceed five years. This notice of intent is not a Request for Quotation (RFQ). Gray Market items are Original Equipment Manufacturers (OEM) good sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contract for maintenance of medical equipment (i.e. replacement parts) for VA medical Centers. No remanufacture or gray market items will be acceptable. Vendor shall be an OEM authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or service contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorized letter or other documents from the OEM, such as the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and services associated with the medical supplies, medical equipment and/or service contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. The delivery of gray market items to the VA in fulfillment of an order/award constitutes a breach pf contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to the VA facility upon discovery of such items. No soliciation will be made available. Information received will normally be considered solely for the purpose of determining whether to conduct competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to the notice is solely within the discretion of the Government.
