THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOT A REQUEST OF COMPETITIVE PROPOSALS. The U.S. Army Medical Research Acquisition Activity (USAMRAA) in support of the Defense Centers for Public Health- Aberdeen (DCPH-A), intends to award a firm fixed price contract on a sole source basis, in accordance with FAR 13.106-1(b)(1), with Thermo Fisher Scientific doing business as Thermo Electron (CAGE 3WXJ7), 1400 Northpoint Parkway STE 10, West Palm Beach, FL 33407-1976 the only responsible source that can perform the maintenance and repair on Thermo Fisher instruments. This acquisition is being conducted under FAR Part 13 Simplified Acquisition Procedures. Provisions and clauses in effect through Federal Acquisition Circular 2023-06 are incorporated. DCPH-A intends to procure a firm-fixed price, for a twelve-month base period and 4 twelve-month options periods for a total contract duration of sixty-months, for several Thermo Fisher Laboratory instruments. Thermo Electron will provide the following services: Annual preventive maintenance using Thermo Fisher certified parts Repair services using Thermo Fisher certified parts Software support services Software updates Technical support calls Thermo Fisher Scientific is the sole source equipment manufacturer and service provider for all Thermo Fisher Scientific instruments, parts, training, technical support, field service support, and software that is mission critical to the function of the DCPH-A-LAB Directorate. The Thermo Fisher equipment is proprietary, diverse, and highly complex which requires specially certified service engineers to efficiently repair instrumentation specifically original equipment manufacturer (OEM) trained service technicians and parts. Thermo Fisher Scientific Field Service Engineers are the only certified and factory trained engineers available to service Thermo Fisher instruments and are part of an organization that is International Organization for Standardization (ISO) certified. Thermo Fisher Scientific has propriety rights to software, access to performance verified component parts, technical support, upgrades and engineering resources to maintain the original operating specifications. This announcement fulfills the synopsis requirements under FAR 5.203. This Notice of Intent is not a request for competitive proposals or quotes. Information received in response to this notice will be considered solely for the purpose of determining whether a competitive procurement is in the best interest of the Government. Interested concerns must submit their capability statement in writing to the email address listed below by the listed due date and time. Submissions that request documentation or request additional information or that only ask questions will not be considered affirmative responses and will not be considered valid. Responses not considered valid will not be evaluated further. If no written responses are received by the date listed below, which reflects at least 15 days after the publication of this notice, the contract will be issued as sole source. All questions and responses concerning this notice shall be emailed to the Contract Specialist, Tiffany Heath, at tiffany.n.heath3.civ@health.mil. All responsible source may submit a capability statement, proposal, quotation, or exception to the intent to award on a sole source basis. Be advised that the aforementioned information is an anticipatory in nature and not binding. All responding vendors must be registered to the System for Award Management (SAM).
