THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS ARE NOT BEING REQUESTED. This notice relates to the acquisition of commercial services for which the Government intends to negotiate with only one source. This acquisition will be processed under Revolutionary Far Overhaul (RFO) FAR Part 12.102(a) Restricting Competition; only one source is available. It is the intent of the U.S Department of Health and Human Services (HHS), Administration for Children and Families (ACF), to negotiate on a sole-source basis with Gruntwork, Inc. of 1184 Monterey Pl, Encinitas, CA 92024 for commercial support services for OpenTofu, an open-source infrastructure-as-code (IaC) platform used to provision, manage, and maintain ACF s cloud infrastructure. The Government requires commercial support services for OpenTofu to maintain ACF's cloud infrastructure provisioning and management operations without interruption. Support services shall include timely technical assistance for OpenTofu-related issues, ongoing access to maintained IaC module library, and delivery of updates and patches consistent with OpenTofu releases. The Government requires technical support within timeframes consistent with the severity of the issue and the terms established in the vendor agreement being either next-day or same-day response time. Critical issues affecting ACF's ability to provision or manage cloud infrastructure shall receive priority response of same-day response. Maintained IaC modules provided under this engagement shall remain compatible with ACF's existing cloud environment and infrastructure configurations. Any module updates or deprecations shall be communicated to ACF with for review and testing prior to implementation. All services shall be delivered in a manner consistent with HHS and federal IT security standards including FISMA and applicable HHS security policies. The Contractor shall not require access to government systems, and all support interactions shall be conducted through approved communication channels consistent with ACF IT governance requirements. This sole source acquisition is necessary to maintain ACF's cloud infrastructure provisioning and management operations without interruption. No other services or products currently available meet the unique Government requirements. The NAICS for this requirement is 541512 Computer Systems Design Services. The small business size standard is $34M. The PSC for this requirement is DA10, IT Telecom and Business Application This action will be executed as a firm-fixed-price, sole-source acquisition under RFO 12.102(a) Restricting Competition, as Gruntwork, Inc. is the only vendor identified that can provide standalone commercial support for OpenTofu in a manner compatible with ACF s existing infrastructure. The period of performance for this requirement shall consist of one (1) 12 month base period and two (2) 12 month Option Periods. Interested Offerors may submit a capability statement not exceeding 5 pages in length which details their ability to satisfy this requirement.
