Based on how the GAO interpreted both provisions in Matter of Phoenix Env t Design, Inc., B-422950 (Dec 10. 2024), it is indeed possible that oral solicitations could potentially be used in acquisitions where the IGE was between $20,000.00 and $350,000.00, as, they indicated that 5.101(a)(2)(ii) overrode 5.101 s general rule requiring that the Contracting Officer is to post for all requirements above $20,000.00. An oral solicitation for a requirement in the $20,000.00 to $350,000.00 range depends on if the Contracting Officer can satisfy the requirement of FAR 13.106-1(c)(1)(ii) that oral solicitation is more efficient than using electronic means.
