Notice of intent to solicit and negotiate with only one source (Sole Source). The U.S. Department of Homeland Security (DHS), Customs and Border Protection (CBP), Office of Acquisition, in support of CBP Operations Support (OS), Laboratories and Scientific Services (LSS), proposes to enter into a Purchase Order on the basis of other than full and open competition to acquire two (2) proprietary Autopol 880 Plus Saccharimeters and accompanying Autoflex Automation Solution autosamplers from: Rudolph Research Analytical 55 Newburgh Road Hackettstown, NJ 07840 UEI: TMSAT2W6ZLK9 The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". The required Autopol Saccharimeters must be totally compatible with the existing CBP-owned lab equipment from Rudolph Research Analytical. Use of compatible equipment is critical in order to ensure testing data and results remain consistent, repeatable, and accurate for CBP trade enforcement. No other manufacturer s equipment is 100 percent compatible with the Rudolph Autopol Saccharimeters and software already owned by CBP. Rudolph Research Analytical is the only source for Rudolph equipment, warranty, training, and (if required) repair services. There are no authorized U.S. resellers of this proprietary equipment or for its warranty, training, and maintenance services. It has been determined, via this notice, and is in the Government s sole discretion, not to compete this contract action. This notice of intent is not a request for competitive quotes. This synopsis does not constitute a solicitation, however all responsible sources that believe they can meet all of the requirements may submit a capabilities statement, which will be considered. Interested parties shall be required to provide a capabilities statement which would demonstrate how they can potentially meet the requirements described above. The Government will review any submittals received in response to this notice prior to 12:00 pm Eastern Time on September 24, 2023. All documentation must be submitted via email. Phone calls will not be accepted. The Government will not be responsible for any costs incurred in the preparation of responses to this announcement. This is the only notice that will be issued for these items. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. From Special Notice posted on Sep 18, 2025The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Laboratories and Scientific Service (LSS), awarded Purchase Order 70B06C25P00000693 for two (2) proprietary Autopol 880 Plus Saccharimeters and accompanying Autoflex Automation Solution autosamplers (SAC) from Rudolph Research Analytical to be installed in the New York Laboratory. LSS requires these exact systems due to the inability of any other system to satisfy the compatibility requirements with existing equipment. The two (2) Rudolph 880 Plus System with Autosamplers must be absolutely compatible with the existing Rudolph systems, standardized methods, and software already used by CBP in the laboratory to ensure consistency of results for trade enforcement. The Autopols are used as an analytical tool to determine the quantification of sucrose in raw sugar. Moreover, the procurement of these instruments is in support of CBP Directive 3820- 001B, which states the guidelines for the sampling and testing of raw sugar importations, as well as it will be utilized for facilitating legitimate international trade, and ensuring that importations to the United States follow the federal regulations, including quota and tariff requirements. Accurate and repeatable test results are required in the classification of such imports as dictated by the Harmonized Tariff Schedule of the United States (HTSUS). There are no authorized U.S. resellers or authorized preventative maintenance and repair services providers of this equipment. Rudolph Research Analytical is the only source for this requirement.
