Under the authority of 10 U.S.C. 2304(c)(1) implemented by FAR 6.302-1(a)(2), the U.S. Army Corps of Engineers, Norfolk District, intends to procure, on a sole source or brand name or equal basis, several components in support of the upcoming construction project for a Fuel System Maintenance Dock (Hangar) at Joint Base Langley-Eustis – Langley Air Force Base. The manufacturer’s products have unique capabilities that meet the user’s stringent requirements for top-quality and secure requirements and maintains compatibility with existing systems. Unless indicated to be as a brand name or equal requirement, the companies listed in the table below are the only manufacturers in the industry that manufactures components to meet required specifications and warranty requirements and maintain compatibility with existing systems. Due to the unique operational requirements, the user requires a homogeneous system that reduces the risk to compatibility/interoperability with existing systems already tested and in use. The Contracting Officer intends to prepare a Justification and Approval documentation (J&A) which includes brand name (BN) or brand name or equal (BNE) items for the solicitation package. Items identified as BN or BNE under FAR 6.302-1 and DFARS 206.302-1) are included to sufficiently define the scope of work to be performed, and adequatelyestablish the required level of product quality. See Attachment 2 for specifics regarding Furniture, Fixtures, and Equipment (FFE) All potential responsible sources wishing to demonstrate ability to meet the agency’s requirements may submit a written response with technical capabilities statement, which if timely received, will be considered by the agency. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. It is a market research tool being used to determine the availability of other qualified sources that can meet the requirements identified above. The Government is not obligated to and will not pay for any information received from potential sources as a result of this notice of intent. This Notice of Intent is hereby published in accordance with FAR 5.201. A determination by the Government not to compete the elements of the project listed in the table above based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Norfolk District will consider any responses to this notice received within fifteen (15) calendar days of the posting of the notice.
