NOTICE OF INTENT TO AWARD (SOLE SOURCE / BRAND NAME) Notice of Intent Number: 52000PR260026472 1. Synopsis of the Requirement The Government hereby submits a notice of intent to award a sole-source, brand-name, firmfixed- price contract/purchase order to: Proposed Contractor: Ordnance Cleaning Systems, LLC Contractor Address: 10950 Wellness Way, Concord TWP., OH 44077 Requirement Title: Ordnance Cleaning Systems Brand Name Equipment and Supplies Total Estimated Value: $21,507.00 It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency's requirement. (See attached justification [JOTFOC]). 2. Regulatory and Statutory Authority This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 [specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold]. The statutory and regulatory authorities permitting other than full and open competition are: Regulatory Authority: RFO FAR 6.103-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" (specifically utilizing Brand Name specifications under FAR 11.105 and RFO guidelines). Statutory Authority: 10 USC 3204(a)(1) for DoD/Coast Guard. 3. Acquisition Details North American Industry Classification System (NAICS) Code: 332994 - Small Arms, Ordnance, and Ordnance Accessories Manufacturing SBA Small Business Size Standard: 1,000 employees Product Service Code (PSC): 4940 - Specialized Miscellaneous Maintenance and Repair Shop Equipment Requirement Summary: Delivery of Foam Dispenser Assemblies, 8-Liter bottles of MILFOAM liquid, Control Box Assemblies, and Control Box Supply Hose Assemblies for the USCG SFLC. 4. Submission Instructions to Interested Parties This hereby constitutes a synopsis of the items included in this requirement. This notice is NOT a request for competitive quotes or proposals, and a written solicitation will not be issued. However, responses to this notice demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder critical mission objectives will be considered. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding this program. The Government will not be responsible for any costs incurred by responding to this notice. 5.
