The National Institute of Health, Office of Logistics and Acquisitions (OLAO) intends to negotiate on an other than full and open competition basis with the following vendor: Peak Scientific Inc. Acquisition Description: a. Acquisition purpose and objectives. Approval of a purchase order for Peak Scientific, in Westford, MA, is needed for a maintenance contract for a government owned Peak Scientific Genius 3031 Gas Generators in the Chemistry Department of the Clinical Center. These instrumentation systems are important for patient care testing for the monitoring of various diseases and compliance to treatment plans to ensure optimum patient care and patient safety. b. Project background. The Department of Laboratory Medicine provides state-of-the-art laboratory testing in support of the National Institutes of Health as well as a center of excellence in research and training in laboratory medicine. This instrument is very complex and sensitive and performs multiple test methodologies in the Chemistry Service to meet the demands of high-volume workloads for Mass Spectroscopy testing. To support these demands, we must provide preventative maintenance and service for the gas generators supplying the clinical instrumentation. Without a service agreement, downtime and unforeseen costs associated with breakdowns, we will not be able to provide patient results in a timely, efficient manner required. The alternative plan would be to send out patient care testing requests to a reference laboratory. This would cause an increase in the departmental expenditure costs, impacting the financial budget of the National Institutes of Health and patient care treatment The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements.
