This action will be completed in a two-phased approach: 1) Inspection and 2) Repair. The inspection phase includes teardown, test, and evaluation (TT&E) and is funded on a firm fixed price (FFP) basis. The second phase includes R&R of assets to FMS customers and is funded on a cost plus fixed-fee (CPFF) basis. The Period of Performance will be 14 November 2023 through 13 November 2028, with a 6-month extension option through 13 May 2029. The USG anticipates this effort to be awarded on a sole source basis to Sielman S.A., A Industrial Area, Road C-6, 38500, VOLOS, GR, Greece, CAGE Code G1005. The statutory authority permitting other than full and open competition is 10 U.S.C. Section 3204(a)(7), as implemented in Federal Acquisition Regulation (FAR) 6.302-7, full and open competition need not be provided for when the head of the agency determines that it is not in the public interest in the particular procurement concerned. Subsection 1244(a)(2) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (NDAA FY2023), as amended by section 1242 of the FY24 NDAA, implemented in DPC Class Deviation 2024-O0005, provides that a covered contract may be presumed to be in the public interest, and waives the requirements at FAR 6.302.7(b) to discuss why none of the other exceptions to full and open competition apply.
