NOTICE OF INTENT TO SOLE SOURCE The Department of Veterans Affairs, Network Contracting Office (NCO) 7 intends to award a contract in accordance with RFO 6.103-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. NCO 7 intends to negotiate and award to Apogee Consulting Group, P.A., a sole/single source, firm-fixed price contract for construction period services (CPS). Project: 619A4-23-104 Replace Generators for Building 5 and 90. The current design contract is 100% complete but no longer has construction period services as part of the scope. The requirement is to provide engineering services for post award activities associated with the construction contract awarded for subject design project. The intent is to retain the A-E designer of record (DOR) for the solicitation and for the duration of the project construction contract. The construction period of performance is 365 calendar days after issuance of Notice to proceed. Required services include, but are not limited to construction submittal reviews, responses to contractor Requests for Information (RFI s), execution of design changes and potential design changes, and attendance at necessary site visits and construction related meetings in order to ensure the DOR s design is properly executed, adjusted, and interpreted in order to deliver a complete and useable facility consistent with original design intent. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and no solicitation will be issued; however, any System for Award Management (SAM) registered firm that it can meet the requirement may give a written notification to the Contracting Officer in the form of a capability statement, including an explanation how the contractor would be able to effectively and efficiently operate in the same footprint as the AE contractor at the same time. Any prospective design firm will need to possess working knowledge of all issues that may arise and will assume the liabilities associated with all aspects of the design. Responses must be provided by March 11, 2026 by 1:00 PM EST. A determination by the Government not to compete this procurement will be based on market research, including responses to this notice. It is within the Government's sole discretion to decide whether the information received in response to this notice warrants development of an alternative approach or not. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. There will not reimbursement to any firm for developing a response to this notice. The NAICS code is 541330 and the size standard is $25.5M. No responses to this notice are requested.
